If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. Once you place an order and/or make payment to Twenty Three Flowers, you automatically enter into an agreement with Twenty Three Flowers accepting these Terms & Conditions.
Twenty Three Flowers reserve the right, at our sole discretion, to update, change or replace any part of these Terms & Conditions; in case of any disputes, the decision of Twenty Three Flowers shall remain final. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the service following the posting of any changes to these Terms & Conditions constitutes acceptance of those changes. References to “you” or “your” shall mean the person authorized to access and use this site. References to “we”, “us” or “our” shall mean Twenty Three Flowers.
1. Website Use
All images, descriptive matter, specifications and advertising on our website are for the sole purpose of giving an approximate description of the goods. Whilst we endeavour to show an accurate colour image, you are advised that there may be variations in colour between the actual goods you receive and the image that you see on your monitor 's display. This could be caused by the settings of your system or an adjustment made during or after photographic or other electronic processes.
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
2. Protection of Privacy
Your personal details will only be used and disclosed for the purpose for which you have provided it, not for any other purpose without your consent. We take all reasonable steps to protect your personal information from misuse, loss, unauthorised access, modification or disclosure and information is stored securely whether in an electronic or physical form. Any data destroyed is disposed of in a way which protects the privacy of information in an appropriate manner.
3. Limitation of Liability
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Twenty Three Flowers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
4. Photography Consent
By contracting Twenty Three Flowers for any services and/or event(s), you give consent to Twenty Three Flowers to take and to have full and free use of video/photography, containing their image/likeness. It is understood these images may be used for promotional, news, online/multimedia, research and/or educational purposes by and for Twenty Three Flowers. It is agreed that you are not entitled to remuneration, residuals, royalties or any other payment from Twenty Three Flowers in respect to their image/likeness or its use. We assure you that these photos will be used in a responsible and positive manner.
5. Quotes & Payment
All price quotations given are valid for 28 days from date quoted.
Prices quoted are in Singapore dollars (SGD). Twenty Three Flowers does not charge GST. Payment should be made to Twenty Three Flowers via cheques and bank transfers only.
6. Flower Bouquets
a. Twenty Three Flowers will endeavour to source flowers as specified in the proposal, however due to the fragile nature of floral we can not guarantee supply. Should any of the flowers or colours mentioned be unavailable due to seasonal differences, shipment delays, or other unforeseen circumstances, we will select an alternative in keeping with the overall design, without prior notice or obligations to you.
b. Twenty Three Flowers will not be responsible for flowers once it has left our care.
c. Space for creativity is greatly appreciated - orders for exact replication of bouquets may not be entertained.
d. Refunds or cancellations on bouquet purchases will not be entertained. There will no refunds to any payment made to Twenty Three Flowers.
e. As a home-based florist, we may not be able to accept all orders as much as we like to. Twenty Three Flowers reserves the right to reject orders without obligations to you. Orders have to be placed at least 3 working days in advance from your desired collection/delivery date.
f. To secure your purchase, full payment (100%) is required within 48 hours of the date of the invoice.
g. Should you decide to cancel your purchase more than 48 hours prior to collection/delivery date (therefore having paid the full payment), full payment will be refunded minus 10% cancellation charge from total amount charged on invoice. Should you decide to cancel your purchase less than 48 hours prior to collection/delivery date (therefore having paid the full payment), you will not be eligible to receive a refund. Twenty Three Flowers reserves the right to amend the above cancellation policies and may forfeit all payment if any production has begun.
h. Delivery is charged at $20 for orders under $100. A delivery charge of $40 is required for delivery to these areas: Airports, Sentosa Island, Military Camps/Areas, Protected Areas, Changi Airfreight Center, Jurong Port, PSA Terminal/Wharves, and Jurong Island. Self-collection of orders will be at 109B Depot Road (Singapore 102109).
7. Events Booking
a. To secure your booking, you're required to make payment for a deposit as stated in the invoice within 7 days of the invoice. This deposit is non-refundable and non-transferable to any other event.
b. The outstanding balance is due 3 weeks prior to the date of your event. If payment is not received by the stipulated date, we reserve the right to withdraw acceptance of your booking and all payments will be non-refundable - Twenty Three Flowers will not be liable for any expenses incurred in such circumstances.
c. Cancellation of bookings must be done in writing through email. Should you decide to cancel your booking more than 1 month in advance of your event, you will not be required to pay the outstanding balance. Should you decide to cancel your booking 1 month in advance of your event, you will be required to pay a cancellation charge equivalent to 50% of your outstanding balance. Should you decide to cancel your booking 3 weeks prior to your event (therefore having paid your outstanding balance), you will be eligible to receive a 25% refund of the outstanding balance. Should you decide to cancel your booking 2 weeks prior to your event (therefore having paid your outstanding balance), you will be eligible to receive a 10% refund of the outstanding balance. Should you decide to cancel your event 1 week prior to your event (therefore having paid your outstanding balance), you will not be eligible to receive a refund.
d. Twenty Three Flowers reserves the right to amend the above cancellation policies and may forfeit all deposits and payment if any production has begun.
e. For services rendered involving made to order products, all payments will be non-refundable.
8. Prop Rentals
a. For the purpose of this document, the following titles will be defined.
- “Props” – Products hired out by Twenty Three Flowers to the hirer for an agreed fee.
- “Owner” – Twenty Three Flowers.
- “Hirer” – Persons renting props from Twenty Three Flowers for an agreed fee.
b. To secure booking of props, the Hirer agrees to pay an initial deposit of 50%. Payment for outstanding balance is due 7 days prior to handing over your props.
c. A $200 Security Deposit Fee must be paid together with the outstanding balance. The Security Deposit Fee is refundable upon receiving the props in the same condition as they were hired. The Security Deposit Fee is refunded within 5 days of collection of the props. A portion of, or the entire deposit fee will however be deducted if the props are damaged or broken beyond acceptable wear and tear. Should any prop(s) become lost, stolen or damaged when in possession of the Hirer, the Hirer shall immediately notify the Owner. The Hirer agrees to pay for all props lost, destroyed, stolen, damaged or not returned to the Owner. All costs will be paid to the Owner based on the current pricing and availability of the identical products in the market. Should no equal product be found by the Owner then the Hirer shall reimburse the Owner at the cost said by the Owner. All reimbursements shall be paid within 48 hours from the drop off of all products and may be subjected to late fee if overdue.
d. Should the Hirer fail to return the props within the allocated time frame at an agreed time and location by both parties, a late fee will be incurred at 10% of the hiring cost for every day the products have not been returned. This sum will be taken from the Security Deposit Fee received by the Owner from the Hirer for the props.
e. If through circumstances beyond the control of the Owner, the Owner is unable to provide the props, then the Owner may (a) Make changes to the props provided, or (b) Cancel a booking by notice in writing.
f. The Owner reserves the right to replace props with a suitable substitute in the event of unavailability.
g. Should you decide to cancel your booking 1 month prior to date of handing over props, full initial deposit amount will be refunded minus $30 cancellation charge. Should you decide to cancel your booking 2 weeks prior to date of handing over props, 50% of initial deposit amount will be refunded minus $30 cancellation charge. Should you decide to cancel your booking 1 week prior to date of handing over props (therefore having paid your outstanding balance), 25% of initial deposit amount will be refunded minus $30 cancellation charge. Should you decide to cancel your booking less than 72 hours prior to date of handing over props (therefore having paid your outstanding balance), you will be charged the agreed full sum and not be eligible to receive a refund. Any other cancellation outside of the above agreement shall be at the discretion of Twenty Three Flowers.
h. Twenty Three Flowers reserves the right to amend the above cancellation policies and may forfeit all deposits and payment if any production has begun.
i.Twenty Three Flowers reserves the right not to apply a cancellation fee in certain circumstances which will be agreed in writing at the time.
